GUIDED OFF-ROAD TOUR TERMS & CONDITIONS
(Applicable in British Columbia, Canada)
1. General
These Terms and Conditions (“Terms”) apply to all guided off-road and camping tours (“Tour”) operated by Western Red Adventures LTD (“the Operator”). By booking or participating in the Tour, each participant (“the Customer”) acknowledges that they have read, understood, and agree to abide by these Terms. These Terms constitute a legally binding agreement under the laws of British Columbia, Canada.
2. Right of Refusal and Termination of Service
The Operator may refuse participation to any person at any time for reasons including, but not limited to, safety concerns, intoxication, failure to follow instructions, or behavior deemed inappropriate or unsafe.
The Operator may terminate participation immediately if a Customer’s actions or condition endanger themselves, others, or property.
No refunds or compensation will be provided in such cases.
The Operator’s decision is final during the Tour.
3. Safety Obligations
All Customers must follow all safety instructions of the Operator and its staff.
Customers must wear all required safety gear (seat belts, helmets, life jackets, etc.) whenever directed.
Only sober, designated drivers may operate vehicles. Driving under the influence of alcohol or drugs is strictly prohibited and will result in immediate removal from the Tour without refund.
Unsafe driving, speeding, or off-trail conduct is prohibited.
Watercraft Use (Paddle Boards, Kayaks, etc.)
Customers using personal watercraft do so entirely at their own risk.
The Operator is not responsible for the condition or safety of personal watercraft.
Use of personal watercraft without proper safety gear (life jacket/helmet) releases the Operator from all liability, including negligence.
When the Operator provides watercraft or gear, life jackets and helmets (where applicable) must be worn.
Misuse of any equipment or engaging in dangerous behavior will result in immediate removal from the Tour without refund.
Participants acknowledge that water activities carry inherent risks (drowning, collision, environmental hazards) and voluntarily assume those risks.
4. Alcohol Consumption
Responsible alcohol consumption is permitted only at designated campsites and only after all driving and vehicle activities have concluded for the day.
Alcohol use is subject to local laws and site regulations.
Customers must drink responsibly and maintain respectful behavior toward others and staff.
Any intoxication that leads to disruptive, unsafe, or disrespectful conduct will result in immediate removal from the Tour without refund.
The Operator bears no liability for incidents or injuries arising from alcohol consumption by Customers.
Driving or operating any vehicle, recovery gear, or equipment under the influence is strictly prohibited.
5. Campsites and Facilities
The Tour includes both paid and unpaid camping locations, including public recreation sites.
Customers must follow all campsite rules, including fire safety, waste disposal, and quiet hours.
Customers must keep their campsite clean and tidy.
The Operator is not responsible for fines or penalties resulting from a Customer’s actions or non-compliance with local site regulations.
6. Vehicle Requirements and Responsibilities
a. Bring Your Own Rig
Vehicles must be suitable for off-road travel and meet minimum standards:
All-terrain tires (or equivalent) with at least 50% tread remaining.
Minimum 8 inches (203 mm) ground clearance.
Functional brakes, lighting, and 4WD/AWD systems.
The Operator is not liable for damage or mechanical failure of personal vehicles.
The Operator may assist with coordination to the nearest highway or service location, but the Customer is responsible for towing, repairs, and recovery.
No refunds will be issued for lost Tour days or early departure due to mechanical issues or personal choice.
Customers leaving the Tour early for personal reasons receive no refund or credit.
b. Rental Vehicles
Customers using vehicles supplied by the Operator must follow all operational and safety procedures provided.
Customers must maintain vehicle cleanliness and care.
Damage due to misuse or negligence will be charged to the Customer.
If a rental vehicle becomes inoperable from mechanical failure not caused by misuse, the Operator will issue a pro-rated refund for unused Tour days.
Unauthorized repairs or modifications are prohibited.
7. Personal Belongings
The Operator is not responsible for lost, stolen, or damaged personal belongings. Customers should bring only essential items.
8. Health, Fitness, and Preparedness
Customers are responsible for ensuring they are fit and capable of participating in off-road, outdoor, and camping activities.
All relevant medical conditions or allergies must be disclosed prior to departure. The Operator may refuse participation if a Customer’s condition poses a safety risk.
9. Weather, Itinerary Changes, and Cancellations
The Operator may alter, delay, or cancel any portion of the Tour due to weather, safety, or other factors beyond its control. Alternate routes or campsites may be substituted. Refunds or credits are at the Operator’s discretion.
10. Assumption of Risk and Liability Waiver
Participation in the Tour involves inherent risks, including but not limited to vehicle operation, environmental exposure, wildlife, water activities, and camping.
By joining, Customers voluntarily assume all such risks, including those arising from ordinary negligence.
The Operator and its staff are not liable for any injury, loss, death, or damage unless caused by gross negligence or intentional misconduct.
Customers agree to indemnify and hold harmless the Operator from all claims or demands arising from participation.
Personal travel and accident insurance is strongly recommended.
11. Emergency Procedures
In case of accident or medical emergency, Customers must immediately notify staff. The Operator may arrange evacuation or medical assistance at its discretion. Any costs not covered by the Operator’s insurance are the responsibility of the Customer.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia, Canada, and any disputes will be resolved in the courts of British Columbia.
13. Acceptance of Terms
By booking or participating in the Tour, the Customer confirms they:
Have read and understood these Terms;
Accept all associated risks; and
Agree that these Terms form a legally binding agreement and release of liability.
