Rental Terms & Conditions


Location: British Columbia, Canada

By renting a vehicle from Western Red Adventures Limited (“the Operator”), you (“the Customer”) agree to the following terms and conditions. These terms are legally binding.

1. Booking & Payment

1.1 All bookings must be confirmed via email. Payment options: e-transfer, credit card, or cash on pick-up (credit card on file required).
1.2 A refundable security deposit may be required to cover potential damages or missing equipment.
1.3 By completing a booking, the Customer agrees to all obligations outlined in these Terms & Conditions.

2. Pick-Up & Vehicle Orientation

2.1 Customers must attend a vehicle orientation at pick-up, which includes:

  • Overview of vehicle operation (lights, 4WD/AWD, recovery points)

  • Tire changing and basic maintenance instructions

  • Inventory check of included equipment and accessories

  • Safety briefing for off-road use

2.2 The vehicle’s condition will be documented at pick-up. Customers must review and acknowledge any pre-existing damage.

3. Customer Responsibilities

3.1 Customers must operate the vehicle safely and follow all provincial laws and off-road guidelines.
3.2 Customers are responsible for:

  • Fuel, cleaning, and general upkeep during the rental period

  • Reporting any damage, theft, or mechanical issues immediately
    3.3 Late returns may incur additional fees.

4. Damage, Loss & Liability

4.1 Customers are responsible for any damage or loss to the vehicle or included equipment.
4.2 The Operator is not liable for:

  • Personal belongings lost, stolen, or damaged during the rental

  • Injuries caused by misuse, negligence, or unsafe operation
    4.3 Refunds for inoperable vehicles are at the discretion of the Operator.

5. Alcohol & Substance Use

5.1 Driving under the influence of alcohol or drugs is strictly prohibited.
5.2 Customers must not operate the vehicle while impaired.
5.3 Violation of this section may result in immediate termination of the rental, with no refund.

6. Rental Vehicle Care

6.1 Customers must maintain the vehicle in a clean and safe condition.
6.2 Any damage or excessive dirt may result in deductions from the security deposit.

7. Termination of Rental

7.1 The Operator may terminate the rental immediately for:

  • Unsafe operation

  • Violation of these Terms & Conditions

  • Alcohol or drug misuse
    7.2 No refunds will be issued for terminated rentals due to Customer actions.

8. Waiver and Release of Liability

8.1 The Customer acknowledges that off-road driving involves inherent risks, including vehicle rollover, collisions, terrain hazards, mechanical failure, or other accidents.
8.2 The Customer voluntarily assumes all risks associated with the use of the vehicle, whether on or off paved roads, including risks not covered by insurance.
8.3 The Customer agrees to release, waive, and hold harmless Western Red Adventures Limited, its owners, employees, and agents (“the Operator”) from any and all claims, demands, or causes of action for personal injury, death, property damage, or any other loss, except to the extent caused by gross negligence or willful misconduct of the Operator.
8.4 This waiver applies to any claims not covered by the insurance provided with the rental, including but not limited to:

  • Off-road accidents

  • Equipment malfunction

  • Third-party incidents
    8.5 The Customer acknowledges that they have read, understood, and voluntarily signed this Waiver and Release of Liability, and that it affects their legal rights.

9. Acceptance & Legal Agreement

9.1 By taking possession of the vehicle, the Customer acknowledges and agrees to these Terms & Conditions, including the Waiver and Release of Liability.
9.2 These Terms are governed by the laws of British Columbia, Canada.
